EARLY RETIREMENT / REDUNDANCY COMMITTEE

 

Minutes of a meeting held on 12th July, 2018.

 

Present:  Councillor S.T. Edwards (Vice-Chairman in the Chair); Councillors Mrs. C.A. Cave, Mrs. P. Drake, G. John, Mrs. A. Moore and N.C. Thomas.

 

 

156     APOLOGY FOR ABSENCE –

 

This was received from Councillor V.J. Bailey.

 

 

157     MINUTES –

 

RESOLVED – T H A T the minutes of the meeting held on 14th June, 2018 be approved as a correct record.

 

 

158     DECLARATIONS OF INTEREST –

 

Councillor Mrs. A. Moore declared an interest for Agenda Item No. 5.  The nature of the interest was that the individual was a family friend.  Councillor Moore declared a Personal and Prejudicial Interest and withdrew and took no part in this Agenda Item. 

 

Councillors S.T. Edward (Chairman), Mrs. C.A. Cave, Mrs. P. Drake and Mrs. A. Moore declared an interest for Agenda Item No. 7 in relation to redundancies within the Directorate of Learning and Skills.  The nature of the interests was that the Councillors knew one of the individuals, but these were not deemed to be a Personal or Prejudicial Interest. The Councillors remained in the room during consideration of this item.

 

Councillor N.C. Thomas declared an interest in respect of the urgent item under Agenda Item No. 7 relating to redundancies within the Directorate of Learning and Skills.  The nature of the interest was that Councillor Thomas was a personal friend of one of the individuals.  Councillor Thomas declared a Personal and Prejudicial Interest and withdrew and took no part in this Agenda Item. 

 

 

159     EXCLUSION OF PRESS AND PUBLIC –

 

RESOLVED – T H A T under Section 100A(4) of the Local Government Act 1972, the press and public be excluded from the meeting for the following items of business on the grounds that they involve the likely disclosure of exempt information as defined in Part 4 of Schedule 12A (as amended) of the Act, the relevant paragraphs of the Schedule being referred to in brackets after the minute heading.

 

 

160     DETERMINATION OF REDUNDANCY / EARLY RETIREMENT ON THE GROUNDS OF REDUNDANCY – G (DEH) (EXEMPT INFORMATION – PARAGRAPHS 12, 13 AND 14) –

 

Consideration was given to an application for redundancy in respect of the above employee. 

 

RESOLVED –

 

(1)       T H A T the application in respect of G be approved on the basis of Scheme D of the Council’s Discretionary Redundancy Policy and within the financial parameters as set out in Appendix A of the report, subject to no suitable alternative employment arising prior to the date of termination, subject to Resolution (2) below.

 

(2)       T H A T should alternative employment be found for G, the notice be extended to cover any trial period if necessary and Resolution (1) above be revoked, together with any redundancy payment, should the trial period prove successful.

 

Reasons for decisions

 

(1)       To support the Service referred to in the report in achieving financial efficiencies and to meet the budget reductions required of that service.

 

(2)       To ensure that the Council’s policies and procedures are followed and that only appropriate payments are made.

 

 

161     DETERMINATION OF REDUNDANCY – P(1), B(1), R(1), S(1), J(1), C(1), C(2), S(2), R(2), C(3), F(1), A(1), P(2) AND A(2) (DLS) (EXEMPT INFORMATION – PARAGRAPHS 12, 13 AND 14) –

 

Consideration was given to a series of application for redundancies in respect of the above employees within the Directorate of Learning and Skills.

 

RESOLVED –

 

(1)       T H A T the voluntary redundancy / early retirement payments as appropriate in respect of P(1), B(1), R(1), S(1), J(1), C(1), C(2), S(2), R(2), C(3), F(1), A(1), P(2) and A(2) be approved, on or before 5th October, 2018. 

 

(2)       T H A T the voluntary redundancy payments for P(2) on 30th December, 2018 (following notice given on 5th October, 2018) coincide with the transfer to the new team as part of the implementation of the new service delivery model, subject to Resolution (5), be approved.

 

(3)       T H A T on the basis of age and length of service, a redundancy payment / early retirement as appropriate be approved effective on the employee’s last day of employment within the Council in respect of P(1), B(1), R(1), S(1), J(1), C(1), C(2), S(2), R(2), C(3), F(1), A(1), P(2) and A(2), or such earlier date as determined by the Director of Learning and Skills in consultation with the employees, subject to Resolution (5) below.

 

(4)       T H A T on the basis of length of service, a redundancy payment be approved with effect from 30th December, 2018 for P(2) or such earlier date as determined by the Director of Learning and Skills in consultation with the employee, subject to Resolution (5) below.

 

(5)       T H A T should alternative employment be found for any of the individuals cited in Resolutions (1) to (4) above, that notice be extended to cover any trial period if necessary, and Resolutions (1), (2), (3) and (4) relevant to that individual be revoked, together with any redundancy payment / early retirement should the trial period prove successful.

 

(6)       T H A T the Director of Learning and Skills be given authority to agree or not agree PILONs (Payment in Lieu of Notice) or availability of the individuals cited above to work their twelve weeks’ notice period as deemed necessary following consultation with the individuals cited in the Resolutions above.

 

Reasons for decisions

 

(1)       To ensure that the costs associated with the service area outlined in the report are contained within available budgets.

 

(2)       To ensure the Council complies with relevant employment legislation in paying, where applicable, an appropriate redundancy payment to staff based on length of service.

 

(3)       To support the Council in maintaining sustainable service delivery.

 

(4)       To maintain compliance with the Council's agreed Management of Change Policy and procedures and to support service area outlined in the report in maintaining sustainable service delivery.

 

(5)       To maintain compliance with the Council's agreed Management of Change Policy and Human Resource Policies such as Avoiding Redundancy and Redeployment as appropriate.

 

(6)       To provide sufficient flexibility for the Service to effectively implement the forthcoming changes whilst ensuring that individual circumstances are able to be dealt with in the most appropriate and efficient manner in consultation with the employee(s).

 

 

162     MATTER WHICH THE CHAIRMAN HAD DECIDED WAS URGENT –

 

RESOLVED – T H A T the following matter which the Chairman had decided was urgent for the reason given beneath the minute heading be considered.

 

 

163     DETERMINATION OF INVOLUNTARY REDUNDANCY – C(1), C(2), H(1), M(1), J(1), S(1), A(1), K(1), K(2), V(1), R(1) AND C(3) AND VOLUNTARY REDUNDANCY – M(2) AND C(4) (DLS) (EXEMPT INFORMATION – PARAGRAPHS 12, 13 AND 14) –

Urgent by reason of the need to make a decision before the next Committee meeting set for September

 

Consideration was given to a number of redundancies in respect of the Directorate of Learning and Skills. 

 

RESOLVED –

 

(1)       T H A T the involuntary redundancy / early retirement payments as appropriate be approved in respect of C(1), C(2), H(1), M(1), J(1), S(1), A(1), K(1), K(2), V(1), R(1) AND C(3), on or before 12th October, 2018 (following the Early Retirement / Redundancy Committee on 12th July, 2018 and meetings with Trade Unions and staff week beginning 16th July, 2018) in order that the service area outlined in the report can implement the restructure subject to Resolutions (4), (5) and (6) below.

 

(2)       T H A T the voluntary redundancy / early retirement payments as appropriate be approved in respect of M(2) and C(4) on or 5th October, 2018 (following the Early Retirement / Redundancy Committee on 12th July, 2018) in order that the service area outlined in the report can implement the restructure subject to Resolutions (4), (5) and (6) below.

 

(3)       T H A T on the basis of both age and length of service, a redundancy payment / early retirement as appropriate be approved effective on the employee’s last day of employment with the Council in respect of C(1), C(2), H(1), M(1), J(1), S(1), A(1), K(1), K(2), V(1), R(1), C(3), M(2), C(4) or such earlier date as determined by the Director of Learning and Skills in consultation with the employee(s) subject to Resolutions (4), (5) and (6) below.

 

(4)       T H A T should alternative employment be found for any of the individuals cited in Resolutions (1) , (2) and (3) above, the notice be extended to cover any trial period if necessary and Resolutions (1), (2) and (3) as relevant to that individual, be revoked together with the redundancy / early retirement payment should the trial period prove successful.

 

(5)       T H A T should the individual(s) employment in Resolutions (1), (2) or (3) above terminate for any other reason in the interim period prior to the termination date, then no redundancy payment will be due.

 

(6)       T H A T the Director of Learning and Skills be given authority to agree or not agree PILONs (Payment in Lieu of Notice) or availability for the individuals cited in the Resolutions above to work their twelve weeks’ notice period as deemed necessary following consultation with the individuals cited in the Resolutions above.

(5)       To allow flexibility for all potential individual eventualities.

 

(6)       To provide sufficient flexibility for the service to effectively implement the forthcoming changes whilst ensuring that individual circumstances are able to dealt with in the most appropriate and efficient manner in consultation with the employee(s).
