Application Process

• Automatic Entitlement to make gaming machines available (upto 2 gaming machines)
  The licence holder must give written notification to the licensing authority and pay the prescribed fee.

  If the premises licence is transferred under the Licensing Act 2003, the automatic entitlement is cancelled, and the new premises licence holder will need to give written notification and pay the prescribed fee if they wish to continue offering gaming machines on the premises.

• Licensed Premises Gaming Machine Permits (3 or more gaming machines) 

  The licence holder must make a written application to the licensing authority and pay the prescribed fee.

  The permit does not expire, but there is an annual fee payable. 

   

  The first annual fee must be paid within 30 days of the issue of the permit, and thereafter before the anniversary of the issue of the permit. Failure to pay the annual fee will result in the revocation of the permit.

  The permit must be kept on the premises to which it applies and the authority can cancel the permit if this is not paid.

   

  There are no renewal provisions for this class of permit because these permits are indefinite. 

•  Transfer
  If the premises licence is transferred under the Licensing Act 2003, the new premise licence holder may apply to transfer the Gaming Machine Permit by completing the relevant sections of the application form, returning the current permit and paying the prescribed fee.
• Vary number of machines 
  If the permit holder wishes to vary the number or category of machines they make available, then they must complete the relevant sections of the application form, return the current permit and pay the prescribed fee.

   

  The permit will cease to have effect if the holder gives written notification of the surrender the permit, or if the premises licence no longer has effect, or if the permit holder ceases to be the holder of the premises licence.

Background and Eligibility Criteria

• Automatic Entitlement to two machines (notice)

  Section 282 of the Gambling Act 2005 provides an automatic entitlement to up to two gaming machines of Category C or D for use in alcohol-licensed premises.

   

  To take advantage of this entitlement, the person who holds an on-sales licence must give notice to the Licensing Board of their intention to make gaming machines available for use and must pay the prescribed fee.

• Licensed Premises Gaming Machine Permits 
  The Licensing Authority may also issue licensed premises gaming machine permits for any number of category C or D machines in licensed premises (with the exception of off-sale premises).  Where a permit authorises the making available of a specified number of gaming machines, this will effectively replace, and not be in addition to, any automatic entitlement.

   

  Pubs and other alcohol licensed premises are automatically entitled to two category C or D gaming machines. For three or more machines you will need a gaming machine permit. The permit authorises the use of Category C and D machines only.

   

  Please note: Where a gaming machine permit authorises the making available of a specified number of gaming machines in particular premises, this will effectively replace, and not be in addition to, any automatic entitlement to two machines.

•  Alcohol with food

  It is important to note that this process relates to premises, with a Licensing Act 2003 on-premises alcohol licence, that serve alcohol without the requirement that it accompanies food.

   

  Pubs, restaurants or hotels will be able to notify/apply for a permit - but only if they have a bar. Hotels and restaurants that serve alcohol only with food, will not be able to provide gaming machines on the premises.

   

  Holders of alcohol-licensed premises gaming machine permits must comply with the Gambling Commission Licence Conditions and Code of Practice which has been drawn up by the Gambling Commission on the location and operation of machines.
